The project \"A society free of violence\" at the Palestinian Center for Democracy and Conflict Resolution organised a round table entitled \"Divorce in exchange for a general discharge\" on Thursday at the Carinos restaurant in Gaza City, with the participation of a number of officials representing the government and civil society organisations and with 30 women and community activists attending.<\/p>\n
The lawyer at the Palestinian Center for Conflict Resolution, Ahmed Hassouna, pointed out that divorce in exchange for a general discharge is an application submitted to the sharia court by agreement between the spouses to end the marital relationship, after the couple have become convinced that married life between them cannot continue. He added: \"This procedure entails the woman giving up all her lawful marital rights in exchange for the husband divorcing her with a single irrevocable minor divorce by which she regains control of herself. In most cases a wife resorts to this procedure because of poor marital treatment, the length of litigation and the absence of religious conscience in some husbands.\"<\/p>\n
For his part, a member of the Supreme Sharia Court and head of the lawyers' committee, Saeed Abu Al-Jibeen, said: \"Islam has stressed respect for the sanctity of marriage and attention to the inner cohesion of families, and resorting to divorce comes only after every means of resolution between the spouses has been exhausted,\" calling on members of the sharia court to be careful and deliberate in issuing divorce rulings, to be keen to listen to both parties, husband and wife, and to be sure of the divorce issued in terms of its number and type, since it determines the family's fate.<\/p>\n
On the laws supporting women in Palestine, the director of the Centre for Women's Legal Research and Consulting, lawyer Zainab Al-Ghunaimi, explained that the existence of the khul' law in Palestinian society came about as a result of institutional pressure by women's organisations to obtain women's rights and to free them from men's control imposed by force. She stressed the need to entrench new laws and concepts that give the right to equality between men and women in law in the future.<\/p>\n
For his part, the executive director of the Palestinian Mukhtars Association, Nader Al-Masri, stressed that reconciliation figures and mukhtars play an effective role in addressing problems between disputing spouses and in pressing for women to be treated justly by their husbands. He pointed out that his association defends the rights of both spouses in accordance with custom and religion, does not push women to give up their rights, and is keen for the Palestinian family always to remain cohesive.<\/p>\n
During the round table meeting, the participants recommended the need to turn to Islam in resolving disputes between spouses, and that men bear great responsibilities in addressing their problems with their wives through advice and guidance, in addition to calling for intensifying counselling meetings in marginalised areas and through the media in order to ensure social cohesion.<\/p>","protected":false},"excerpt":{"rendered":"
