The Palestinian Center for Democracy and Conflict Resolution, within the Justice for All project, organised a workshop entitled \"Towards creating enforcement departments dedicated to the sharia courts and activating the maintenance fund\", in partnership with the United Nations Development Programme (UNDP), in the Royal Palace hall in Khan Younis governorate.<\/p>\n
At the start of the workshop, the president of the Khan Younis Court of Appeal, Dr. Ibrahim Al-Najjar, stressed that the sharia judiciary law clearly provides for the enforcement of the judgments issued by the sharia courts and that it will be put into effect once the regulations relating to it are issued. He pointed out that the High Council is seeking to issue the implementing regulations in order to create enforcement departments separate from the sharia courts for enforcing judges' rulings, so as to ease the burden on the courts and on citizens alike.<\/p>\n
For his part, the enforcement officer at the Khan Younis Court of First Instance, Ibrahim Abu Reida, explained that they receive daily between 300 and 400 people with sharia cases and judgments, among them cases of visitation, custody, breastfeeding and household furnishings, and that the court staff work like bees throughout their working hours. He explained that the court's docket holds more than 4,000 cases, both civil and sharia, among them 1,000 sharia cases, and between 250 and 300 cases a month in the enforcement departments.<\/p>\n
For his part, the regular lawyer Saeed Awad pointed out that certain obstacles stand in the way of enforcing some legal and sharia judgments, among them the large volume of enforcement cases, in addition to some lawyers stalling in completing a case because of financial need and the fees paid to the courts in enforcement cases. He called for the need to work in the coming period on finding clear mechanisms to ease the burden on citizens in the courts and to restore rights to their owners.<\/p>\n
During the workshop, the participants recommended the need to issue swift judgments in visitation cases, the need for women staff specialising in social matters to work with women, for police officers to be sent in civilian clothes when parents request to see their children, and to work on establishing social and psychological offices inside the enforcement departments in order to create mutual understanding between the staff of the enforcement departments and the public.<\/p>\n
It is noted that the Justice for All project is currently carrying out more than ten workshops in several Gaza governorates on a number of legal, community and humanitarian issues, with the aim of supporting the citizen and pressing officials and decision-makers to address people's concerns and problems.<\/p>","protected":false},"excerpt":{"rendered":"
