The Palestinian Center for Democracy and Conflict Resolution held a dialogue meeting entitled \"Specialised arbitration: arbitration in property disputes\"<\/strong> Within The project providing legal information, aid and counselling in the Gaza Strip <\/strong>implemented by the Centre in partnership with the Norwegian Refugee Council. The meeting was attended by Mr. Abdel Moneim Al-Tahrawi, project coordinator, Ms. Mona Abdel Aziz of the Norwegian Refugee Council, a number of lawyers working on the project, as well as Mr. Ali Al-Athamna, director of the arbitration department at the Ministry of Justice, a number of representatives of arbitration centres, legal academics, arbitrating lawyers and mukhtars, yesterday at the Al-Salam Abu Hasira restaurant in Gaza.<\/p>\n

Mr. Ahmed Hassouna explained the Centre's reasons for holding this meeting, the most important being: property disputes before the courts usually continue for several years, whereas arbitration proceedings are generally shorter and more precise where a qualified arbitrator is available; and the notable results achieved by specialised arbitration in some countries were an important motive for the Centre to move towards specialised adjudication for the sake of efficiency and innovation in the edifice of justice. In addition, many arbitrators are unfamiliar with the subjects and questions of property disputes, which leads to many arbitration decisions in property disputes being annulled; qualifying arbitrators in property disputes gives their decisions strength and protects them from annulment. There is also the large volume of property dispute cases compared with other types, which makes it essential for all of us, judges, lawyers, centres and institutions, to work together to find ways of resolving this type of dispute by the shortest routes and with the least harm. Women are among the beneficiaries, since the most common property dispute cases concern possession and ownership.<\/p>\n

The meeting, chaired by Ms. Tahani Aziz, included several interventions by those present, from which a number of recommendations emerged, the most important being: spreading a culture among citizens of turning to arbitration as a means of resolving disputes; preparing qualified arbitrators to work in arbitration in property disputes; holding specialised courses supervised by those with experience in arbitration in property disputes and granting them a licence; joint cooperation between all institutions and bodies concerned to produce qualified arbitrators in property disputes; and cooperation between the courts and licensed individuals and institutions working in arbitration in order to reduce the volume of cases before the courts, particularly property disputes.<\/p>\n
