Yesterday the Palestinian Center for Democracy and Conflict Resolution held a round table entitled \"Problems in applying Circular No. 19\/2009 on a divorced mother retaining custody of her children beyond the legal age, on the same basis as the decision concerning widows\"<\/strong>“<\/strong> Within the activities of the project A Step Towards Change<\/strong> implemented by the Centre in partnership with the Norwegian People's Aid office. The meeting was attended by Dr. Omar Nofal, head of the Sharia Court of Appeal, Mr. Abdel Moneim Al-Tahrawi, project coordinator, Ms. Samar Hamad, lobbying and advocacy campaigns consultant, civil society organisations, community activists, lawyers and a number of the Centre's lawyers, at the Al-Salam Abu Hasira restaurant in Gaza.<\/h5>\n
The meeting was opened by the Centre's lawyer Mr. Ahmed Hassouna, who welcomed Sheikh Dr. Omar Nofal and those present. In his introduction he highlighted the importance of this meeting, noting that many divorced women suffer from being denied an extension of the custody age or from claiming custody of their children once the impediment is removed after divorce, since Circular 19\/2009 granted only widowed women the right to extend the custody age for their children. The purpose of this meeting is to place divorced women on an equal footing with widowed women in the matter of extending the custody age, given that a large number of divorced women suffer from this issue, which is both humanitarian and legal.<\/h5>\n
For his part, Sheikh Dr. Omar Nofal noted that many circulars issued by the Higher Sharia Judicial Council, particularly in recent years, have brought benefits and a qualitative shift for women in many matters concerning both wives and children. He added that this subject is open to discussion, dialogue and study among specialists, and that all rights organisations concerned with such matters should raise their voices and recommendations to the competent bodies in order to bring about change for the better in the interest of the family as a whole. Finally, he noted that it is essential for the organisations carrying out such activities to consider the balance of interests between women and men in a way that serves the interest of society.<\/h5>\n
The meeting included several interventions, from which a number of recommendations emerged, the most important being: placing divorced women on an equal footing with widowed women in their right to claim custody of their children; resorting to reconciliation committees before turning to the courts in matters of child custody; and focusing on the child's interest, taking into account the mother's ability to meet her children's needs financially and whether her family is able to support her if she obtains custody.<\/h5>\n
