During the session, the results of the assessment prepared by the social accountability team were presented. The team conducted 478 questionnaires in all government hospitals in the Gaza Strip and five focus groups with all the teams working in hospitals across the Strip, in addition to 15 individual interviews with doctors, nurses, anaesthetists and other hospital staff, in order to examine the issue of medical malpractice, its causes and ways to reduce it. The main findings of the assessment regarding medical malpractice were as follows:<\/span><\/p>\n 1. The laws and regulations applied at the Ministry of Health do not limit the occurrence of medical errors, because they are old and need to be developed and amended.<\/p>\n 2. The Ministry of Health forms investigation committees when a medical error occurs, but citizens are sometimes not informed of the committees' findings.<\/p>\n Opening his remarks, Dr. Ahmed Shattat, deputy director general of hospitals, explained that the health sector faces difficult conditions, particularly under the Israeli blockade imposed on the Gaza Strip and the difficulty of importing medical devices and equipment.<\/p>\n Citing statistics, Shattat said there are 2,850 beds in the Strip's hospitals, or 14 beds per 10,000 residents, while hospitals need more than 3,000 beds in order to provide medical services at the required standard.<\/p>\n In the same context, Shattat acknowledged that medical errors do occur and that what he had said earlier does not justify them, noting that the medical errors that occur are assessed against American and European standards because we have no standards of our own.<\/p>\n He added that there are many causes of medical errors, including the wrong choice of medicines, the Ministry of Health's financial crises, and the culture of the public, where a view has taken hold in society that an error is not individual but the error of an entire system. He noted<\/p>\n that doctors are not infallible, in his words, and pointed out that the Ministry requires all doctors to sit professional practice examinations before starting work.<\/p>\n For his part, Saeed Al-Batta, director general of legal affairs at the Ministry of Health, said that medical error is a global phenomenon occurring all over the world, and that responsibility is therefore collective, whether on the part of the Ministry of Health, the Legislative Council, human rights centres or the citizen. He explained that the Ministry gives attention to complaints submitted by citizens: specialised investigation committees are formed after hearing the statements of the citizen and the medical team, the medical record is reviewed, and the committee then submits reports and recommendations setting out whether there was a medical error or medical negligence. He stressed the difference between negligence and medical error, so that the necessary penalties and procedures can be taken under Article 86 of the relevant law, with the penalty implemented after addressing the Civil Service Bureau.<\/p>\n Al-Batta noted that the Ministry informs the complainant of the full findings of the investigation while withholding the names of those responsible, since publishing them would amount to defamation. He added that there is a law to protect doctors that has not been enacted because of the prevailing political situation, and called for cooperation between citizens and the Ministry, explaining that there are twelve cases before the courts, only one of which has been decided. He also explained that the protocols applied at the Ministry of Health are based on quality and performance improvement standards.<\/p>\n He stated that the Ministry does not hold back from highlighting its urgent needs and severe shortages: it addresses donors and communicates with the media in the hope of helping to provide what is needed.
