A discussion circle: many questions
Is a disobedient wife entitled to maintenance? What is the waiting period for a pregnant woman? Is khula applied in the sharia courts? When may a wife bring a suit for separation? What is the ruling on a divorce pronounced in anger?
These are the questions discussed by Mr. Fadi Hamad, the Centre's lawyer, during two workshops held in the hall of the Palestinian Center for Democracy and Conflict Resolution, Middle branch, attended by 40 men on Sunday and Monday of this month.
Mr. Hamad explained that a disobedient wife is a wife against whom a court ruling has been issued to return to her husband's house and who refuses to do so, and that she is not entitled to maintenance. As for the waiting period of a pregnant woman, it ends when she gives birth.
After those present asked about khula and its application in Palestine, Mr. Hamad explained that it is applied on the basis of society's customs and traditions, whereby an agreement is reached between the spouses to separate in return for money the wife pays to her husband, but that it is not actually applied in the sharia courts.
Mr. Hamad also confirmed that the law permits a wife to bring a suit for separation before the sharia court in several cases, such as disagreement between the two parties, a request for separation because of a sexual defect after marriage, the husband's insanity after marriage, the husband's absence, a request for separation because of frequent dispute and discord, and apostasy.
As for a divorce pronounced in anger, it does not take effect unless the anger is of a degree at which the person is unaware of any act he performs, that is to say he has lost consciousness of it.
At the end of the two workshops those present expressed their admiration for the subjects raised and how much they had benefited from them.
