Tender announcement: terms of reference for developing Standard Operating Procedures (SOPs) for the justice of children in conflict with the law

The Palestinian Center for Democracy and Conflict Resolution, in cooperation with Terre des hommes Switzerland, wishes to produce a manual of standard operating procedures for child justice, to be agreed by all parties involved in child justice in their dealings with children in conflict or in contact with the law, including police stations, the public prosecution, the judiciary and the Ministry of Social Affairs.

The manual aims to define the roles and responsibilities assigned to each body involved in dealing with children in contact with the law (the child as offender, victim or witness), with a detailed account of the procedures to be followed in a way that does not conflict with the law and the regulations governing these procedures.

These terms of reference therefore set out the content of the standard operating procedures manual, covering all the procedures a child undergoes, whether as offender, victim or witness, with all the parties concerned, namely:

1. The role of the Palestinian police:

• Receiving the complaint

• Summons

• Investigation

• Detention at the Al-Rabee institution for 24 hours

• Referral to the prosecution

• Police public relations and its communication with reconciliation committees

• Other, if any

2. The role of the public prosecution:

• Investigation

• Bringing charges

• Detention at the Al-Rabee institution for 48 hours or release

• Completing the case file and submitting it to the court

• Attending court hearings

• Other, if any

3. The role of the judiciary:

• Preparing the juvenile's file with a dedicated case number and setting a hearing

• Convening the juvenile court

• Alternative penalties

• Other, if any

4. The role of the Ministry of Social Affairs:

• Procedures for the probation officer's attendance at the investigation with the child at all stages of detention and in court

• Receiving detained children at the Al-Rabee institution

• Measures for the child's stay at the Al-Rabee institution before and after sentencing

• Facilitating legal and psychosocial support for children detained at the Al-Rabee institution

• Following up the child after the end of the sentence

• Communication with reconciliation committees

• Other, if any

General conditions and notes:

1. The tender is open to experienced individuals and to specialised consultancy firms.

2. Please attach a CV that clearly sets out experience in the field of child justice.

3. A detailed technical proposal must be submitted covering the points set out in the terms of reference, explaining the working methodology.

4. A separate financial proposal must be submitted in a sealed envelope in shekels.

5. The assignment lasts 8 weeks from the date of appointment, distributed as follows:

• 6 weeks to submit an initial draft of the manual

• One week for the first draft to be reviewed by the Palestinian Center for Democracy and Conflict Resolution and Terre des hommes Switzerland

6. The work includes training 3 different groups on how to use the manual, one day per group

7. The technical and financial proposals must be delivered by hand in two separate sealed envelopes to the office of the Palestinian Center for Democracy and Conflict Resolution in Gaza, Qasr Al-Hakem Street, no later than Tuesday 10/1/2017 at 12:00 noon
